West Windsor Township Wins Suit with International Schools Services
West Windsor, N.J. -- West Windsor Township Mayor Shing-Fu Hsueh announced today that the Township received notice of a unanimous decision by the Appellate Division, Superior Court affirming an earlier decision by the Tax Court. The Tax Court found that the International Schools Services (ISS) property in West Windsor Township on Roszel Road was not tax exempt.
Until 2002, the ISS property was tax exempt because of its educational purposes. However, the Township challenged that status in 2002 leading to an initial decision by the Tax Court in November 2004 denying the exemption. This first decision was reversed on appeal because the Tax Court had not reviewed all of the elements determining tax exemption. A second decision was reached by the Tax Court in March 2009 again determining that the ISS property did not qualify for tax exemption. A second appeal was filed resulting in the decision just received.
Mayor Hsueh stated, “I am glad that this issue has been settled in favor of the Township. This translates into taxes of over $820,000 from 2002 to 2010 (as projected). This property will now be a significant ratable for the Township and its taxpayers.”
