DEPARTMENT OF LAW Michael J. Herbert Township of West Windsor The Department of Law is headed by the Township Attorney and includes the Township Attorney, Township Prosecutor and Public Defender. The Township Attorney is appointed by the Mayor with advice and consent of Township Council. The Township Attorney serves as legal advisor to the Mayor and Council and to all Township Departments. Specific responsibilities include prosecuting and defending all actions and proceedings by and against the Township, conducting appeals from orders, decisions or judgments, handling all matters of litigation, rendering legal opinions, reviewing and approving as to form all contracts, deeds, documents and instruments prior to Township execution. The Township Prosecutor participates in and prosecutes all cases in Municipal Court including all criminal and quasi-criminal matters and all complaints by Township officials, inspectors and directors. The Public Defender is appointed by the Mayor with advice and consent of Township Council. The Public Defender serves as the defense attorney for any and all indigent defendants charged with a violation of any law, ordinance or regulation of a penal nature which could result in incarceration or substantial fine.
